102/Category-X prior art was identified for solar arrays in corrosive conditions. The technical insights helped the client recognize that the invention’s novel aspect was merely an inherent property of the steel type used. This directly contradicted the patentee’s core argument and helped the client challenge the novelty of a granted patent.

Problem Solved

The client sought to identify earlier patents for solar arrays designed for corrosive soil conditions, specifically focusing on high-grade steel posts with a minimum yield strength of 50 ksi. The challenge was that, while structural details such as I-beam profiles and pointed ends were disclosed, the steel grade was either unspecified or lower than required. Researchers at GreyB expanded the search to scientific literature, identifying studies on corrosion resistance linked to steel strength. However, these studies were based on stainless steel, while the patent in question used black steel, a more cost-effective variant.

Solutions Offered

The turning point in the research came when the team shifted focus from conventional keywords and classes to assess the obviousness of the steel property. This expanded the search to include industry standards for steel selection in solar applications. During this process, we noticed the logo of a company with a scarce patent portfolio on a key presentation. This prompted us to investigate their products further, where we found exactly what we were looking for. This discovery not only connected critical dots but also provided clarity to the case, offering valuable direction for the client.
