The research uncovered pre-cutoff system prior art demonstrating the two critical features of the asserted claim: user-selectable automatic reply messages and automatic activation of a call-suppression mode when a phone connected to a vehicle through Bluetooth.
This gave the client dated, visual evidence for challenging the patent in a high-profile litigation matter. It also established a clear historical link between a later commercial application and its earlier predecessor technology.
Problem Solved
The target claim covered a mobile-phone safety system that:
- Automatically suppressed incoming calls or other distracting sounds when the phone connected to a vehicle’s Bluetooth system;
- Allowed the user to select or customize an automatic reply message; and
- Automatically triggered the suppression mode upon establishing the Bluetooth connection.
Initial searches identified several safe-driving applications that implemented similar functionality. However, their app listings, videos, and supporting articles were published four to five years after the January 2013 cutoff date. Relevant technical evidence existed, but it appeared too late to qualify as prior art.



Solution Offered
Instead of discarding the post-published applications, they were treated as investigative leads. The research team created a list of later safe-driving apps and traced their development histories, owners, and predecessor products.
One application, FleetSafer, disclosed approximately 80% of the required functionality, including automatic activation of a safe-driving mode and suppression of calls, texts, and other distractions. Although the available FleetSafer videos were post-cutoff, further investigation showed that the software belonged to Aegis Mobility.
Corporate-history research then revealed that Aegis Mobility had acquired ZoomSafer in November 2012. Searching for ZoomSafer uncovered:
- A March 2011 article describing the earlier distracted-driving solution; and
- A pre-cutoff YouTube video with subtitles showing users customizing automatic reply messages and the system automatically activating the suppression functionality.
By tracing FleetSafer backward through Aegis Mobility’s acquisition of ZoomSafer, the research transformed a post-cutoff lead into pre-cutoff system evidence. The resulting article and product demonstration supplied strong prior art for contesting the claimed automatic-reply and Bluetooth-triggered suppression features.
