Avoiding $7M in Licensing Fees Using Tier 1 Prior Art from PubChem

Value Delivered

Tier-1 prior art was identified by validating the energy levels of the different compounds on PubChem. This enabled the client to secure a favorable out-of-court settlement, avoiding a costly licensing agreement for a patent valued at up to $7 million.

Problem Solved

The research aimed to identify an OLED structure composed of multiple layers. Each layer contained a specific organic compound carefully selected to manage energy levels and enhance light emission efficiency.

The first challenge was locating an OLED structure with this precise layering and compound-sharing feature. Over 800 patents were scanned using both keyword-based and image-based searches. However, none captured all the claim elements, particularly the shared compound and specific energy values.

Secondly, most documents lacked HOMO and LUMO data, as it is rarely included in published literature. Since the patent claims relied on both structural configuration and specific chemical properties, validating both elements was necessary to meet the client’s requirements.

Solutions Offered

The turning point in the research came when the team identified a recurring pattern. Patents describing similar OLED structures often presented compound information in layer-by-layer tabular formats. By strategically adding the keyword “table” to the search query, a highly relevant reference was uncovered that closely matched the claimed structure.

The energy levels of the compounds used in the OLED layers were validated using PubChem, the world’s largest publicly accessible chemistry database maintained by the U.S. government.
