Problem Solved
The client needed prior art against a patent claim covering a footwear sole structure with channels that deform under load, close completely during compression, and then return to their original shape. While several references disclosed channels that flexed, compressed, or deformed during use, none clearly showed the complete closure of the channel cavity. Since this feature was central to the claim, the available references were not strong enough to support a clear novelty challenge.
The search was difficult because the claim language was narrow, while the prior art used broader terms such as “deform,” “compress,” or “flex.” Conventional keyword searches repeatedly returned references that appeared similar at a high level but did not address the exact limitation. Non-patent literature and public product documents also lacked clear technical proof of how the channels behaved under actual load.
The challenge became more complex because relevant references appeared in non-English jurisdictions, where translation differences created uncertainty around the exact disclosure. The feature itself was dynamic and occurred during product use, making it difficult to verify through static patent drawings or written descriptions. As a result, both AI-driven and conventional search methods reached a plateau despite extensive investigation.



Solutions Offered
To overcome the search limitations, the strategy moved beyond claim terminology and standard keyword-based searching. The team focused on assignees, jurisdiction-specific classifications, and related product families active in footwear sole structures. This helped identify a concentrated prior-art set that earlier AI-driven and conventional searches had missed.
The expanded search uncovered a key reference describing structural gaps in a footwear sole that become crushed under loading conditions. Although the wording differed from the claim, the disclosure aligned closely with the required complete-closure behavior. Since translations of the reference varied, the team reviewed supporting materials to confirm that the disclosure referred to full closure rather than ordinary compression.
Publicly available product materials and independent review content linked to the same assignee provided further confirmation. The review visually showed the channels closing under load during actual use. By combining the documentary reference with real-world product evidence, the team built a stronger invalidity position supported by an anticipatory reference, functional proof, and a clear technical rationale.
