Licensors put declared patent counts on the table and set royalties from there. Licensees accept that framing and negotiate from a position of assumed weakness. The data tells a different story.

Declaration is not the same as essentiality

No governing body verifies declared SEPs. Any company can self-declare a patent as essential to 5G without submitting a claim chart. The declared count is an unverified number.

Essentiality is not the same as implementation

Even if a patent genuinely covers a 5G feature, that feature may not be implemented in your product category. Only 37% of features across Release 15โ€“19 are actually deployed commercially.

Royalties are being charged on features you don't use

When royalties are anchored to declared counts, licensees end up paying for features their products never implement. That gap represents millions of dollars in overpayment at scale.

FRAND is supposed to fix this, but it isn't

Fair, Reasonable and Non-Discriminatory pricing should be anchored in what you actually implement. In practice, it’s anchored in what licensors declare. The two numbers are very different.
