Problem Solved

The client wanted to establish their patent as essential to the HEVC (H.265) standard to make it a strong licensing asset in the HEVC space. However, the patent claim was defined through a broad mathematical expression, while the HEVC specification described the same functionality through layered processes and conditional operations. With no explicit equation-level reference in the standard, demonstrating overlap through conventional claim mapping was challenging, leaving the patent’s SEP relevance uncertain.

Solutions Offered

GreyB conducted a structured, multi-source analysis to trace where the patent’s underlying mathematical logic manifested within the HEVC framework. When the exact equation could not be located in the standard, the team expanded the investigation to relevant non-patent literature.

A critical breakthrough came from identifying a research article authored by the patent’s inventors that disclosed a closely related equation. This intermediary reference bridged the gap between the patent claim and the HEVC implementation. Using this insight, GreyB re-examined the HEVC specification and pinpointed the same operation expressed in a different, yet mathematically equivalent, form.

By aligning the patent claim, the research publication, and the HEVC standard side by side, GreyB conclusively demonstrated that all three embodied the same core technical concept, firmly establishing the patent’s strong SEP relevance within the HEVC ecosystem.
