Strengthened An Invalidation Case On Live Photo Technology Using An Instagram Post
Value Delivered
The client had previously conducted a preliminary search for prior art but could not uncover any concrete results. Consequently, he believed that their case was unlikely to succeed. However, GreyB’s discovery of system prior art proved a critical turning point, leading to the client’s victory in a high-profile litigation case that would have otherwise been lost.
Problems Solved
The novel technology was based on the method of transforming a still photo into a moving or live photo by choosing the direction in which we wanted the still part to move.
Despite finding the entire claim process illustrated in several animated pictures on an Instagram page, we still had difficulty illustrating two essential steps of the claim- “Masking” and “Drawing directions on the still photo.”
Additionally, the scarcity of blogs discussing the software used in creating the animated pictures made it challenging to comprehend the process mentioned in the subject patent.
Solution Offered
As we started searching for the real identity of the software, it led us to a significant finding: its predecessor in relevant disclosures. Focusing on this parent software uncovered information predating the cut-off date.
A particularly valuable discovery was a YouTube video highlighting the novel features of the patent, which was released before the key date. This and Instagram reels related to the process strengthened the prior art findings.
